TERMS AND CONDITIONS OF USE

University Health Care System (UHCS) and Subscribing Providers (SP) offers access to personal medical information, scheduling and other services via a Web-based system called MyChart. The specific personal medical information which may be viewed is maintained on the EPIC electronic medical record system maintained by UHCS and subject to release by the individualís SP.

To request an account, submit a MyChart Consent Form to the MyChart Customer Service department, indicating you have read this Terms & Conditions Statement.

It is important for you to know how we handle the information we communicate via the Internet. This Terms and Conditions of Use outline our practices and our efforts to protect your right to privacy. Because of the sensitivity of some information available on this system, we reserve the right to revoke access to all or part of the services at any time, for any reason.

SERVICES

Electronic Communication Ė MyChart permits submission of inquiries, information, questions, etc. to the SP regarding all aspects of medical care and treatment. Each SP will endeavor to provide a timely response to electronic inquiries. SP are urged to respond to electronic inquiries within (3) three business days; however, staff and information availability may result in a longer response time. Electronic communications should not be used in Emergency or life threatening situations.

Responses to electronic communications are based solely on the information provided by the patient and are limited by the completeness of that information. Electronic responses are not a substitute for direct examination or interactive telephone communication.

SP may use MyChart for monitoring patientsí conditions, verifying compliance with treatment plans or medical regimens, or for support and reinforcement. UHCS is not an intermediary in such uses of MyChart and is not responsible for such uses nor for responses to the information provided in such programs or monitoring functions.

Web Site Links - MyChart may offer links to related medical Web sites not managed by UHCS. These Web site link(s) are for a patientís informational purposes only. UHCS does not endorse the websites and is not responsible for the accuracy, content, or currency of the information in/on these Web sites. Patients should exercise caution when using any of the information found on these Web sites for purposes of treatment or diagnosis. Accurate diagnosis and treatment of diseases and conditions requires consultation with trained medical professionals.

Scheduling - Many SP permit the use of MyChart to schedule appointments, to obtain refill prescriptions, to provide notice of routine periodic tests, and other follow-up. Scheduling services are the responsibility of the patient.

ACCESS TO INFORMATION

All patients whose providers subscribe to MyChart have the opportunity to establish access to their personal medical records and the services available on MyChart without cost.

Children - The parents or guardian of a minor child may establish access to the MyChart account of such child. Certain information concerning treatment and requests for treatment are protected by state and federal statutes. Upon assertion of these rights by a child, parental access to MyChart will be denied. Reactivation of access may be granted upon written authorization signed by the child and a parent. Children of sufficient capacity to request a MyChart account in their own right will be provided MyChart access.

Adult Proxy Access - Individuals age 18 or older may be granted proxy access to another adultís MyChart account upon presentation of an authorization by the adult, presentation of a durable power of attorney for healthcare appointing the requesting party a health care agent, or presentation of a court order appointing guardianship. Completing the Proxy Access portion of the MyChart Consent Form and submitting appropriate documents is required. In the absence of such documents in the case of a patient lacking decision making capacity the person having the highest decision making authority as set out by Georgia law will be granted a proxy access. Only one person will be granted proxy access to a MyChart account except on presentation of a court order establishing dual or equal custodial rights regarding the patient. Proxy access is, in all circumstances, at the discretion of the competent patient.

Upon any provider becoming aware of a change in the legal relationship of the patient and the proxy holder that provider will make its best effort to revoke the proxy access. If the proxy holderís legal relationship with the account holder changes, the proxy must inform UHCS immediately by sending written notice to , University Health Care Services, Attention Epic MyChart Administrator, 1350 Walton Way, Augusta, Georgia 30901. Failure to do so coupled with subsequent access to the account may subject the accessing individual to civil penalties.

E-mail Privacy - Patients who are users of MyChart will be notified via e-mail when there is new medical information to be viewed on MyChart. Any person with access to the patientís e-mail, as established in the patientís profile, will be able to see this notification. Although no private medical information will be sent, limiting access to the notification that new medical information is available on MyChart is the responsibility of the account holder, the patient.

E-mail communications from account holders utilizing the MyChart communication function may be viewed by the UHCS staff that assists in the functioning and operation of MyChart, as well as the physicians and physiciansí staffs involved in providing the patientís medical care.

Security and Confidentiality Ė The medical information accessible on MyChart is given to medical information stored by UHCS in any other medium, in compliance with state and federal statutes and regulations. These statutes and regulation may require changes to accessibility after publication of these terms and conditions. Access to the information maintained on the EPIC database which provides the information available on MyChart follows the statutory and regulatory restrictions applicable to Protected Health Information. Firewalls, passwords, encryption, and audit trails are used to safeguard patient information. The system identifies records accessed by time and date each time an account holder accesses MyChart. Additional security measures may be implemented from time to time to protect against unauthorized access and use. These terms and conditions are governed by the Privacy Principals, available on the MyChart web page.

In order to view Protected Health Information, MyChart must be accessed with a Secure Sockets Layer (SSL) compatible browser or terminal (Netscape or Internet Explorer versions 5.0 or greater). Our SSL web server uses authentication and offers the highest level of encryption technology commercially available (128-bit RC4).

User names and passwords provide two layers of authentication and are stored in an encrypted database that is isolated from the Internet. MyChart account holders are responsible for maintaining the security of your login ID and password. The account holder should periodically change passwords. MyChart may require password change or update on a random basis and may require account holders to verify identity by other means.

ADDITIONAL MATTERS

1. Medical information available on MyChart is not an official medical record and may be limited by the patientís SP. UHCS is not responsible for the amount or extent of information made available by the SP and cannot grant access to information not released by the account holderís SP.

2. UHCS and SP are not responsible for disclosure or loss of Protected Health Information (PHI) because of compromise of the account holderís security information due to the account holderís own actions or failure to protect such information. UHCS and SP are not responsible for loss or disclosure of PHI as a result of action by the account holder to print or otherwise remove, duplicate, or reproduce information from MyChart.

3. The provision of MyChart access to the patients of SP is subject to the terms of the agreements between such SP and create no right of action nor any privilege in the individual account holders who are not in privy to the underlying agreements. UHCS retains the absolute right to limit, modify, restrict, or terminate MyChart, its use by any individual, the content available for access, and any functionality associated with MyChart.

MATERIALS, SERVICES AND OTHER INFORMATION ARE PROVIDED "AS IS" BY UHCS AND THE SP FOR EDUCATIONAL PURPOSES ONLY. UHCS AND THE SP MAKES NO EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR USE, TITLE OR NON INFRINGEMENT.

PLEASE NOTE THAT, BY ITS VERY NATURE, A WEB SITE CANNOT BE ABSOLUTELY PROTECTED AGAINST INTENTIONAL OR MALICIOUS INTRUSION ATTEMPTS.
